All payments shall be made via Credit Card. An Advance Rent Deposit shall be paid at the time of reservation by credit card. The remainder of the Rental Amount is due 31 days prior to the Arrival Date by check. Note, reservation is not confirmed until the Advance Rent Deposit is charged on the Credit Card provided. All reservations are manually confirmed and online reservations are charged within 24 hours of booking. This agreement will not be considered in full effect or enforceable until the Advance Rent Deposit is charged to the Credit Card provided at the time of Reservation.
Rates are not guaranteed until reservation is confirmed and Advance Rent Deposit is charged to the Credit Card provided. Rates are not guaranteed and subject to change anytime until reservation is confirmed with payment of Advance Rent Deposit. No guarantees are made that future season rates are set and accurately published until Advance Rent Deposit is charged to the Credit Card provided at the time of reservation.
AMENITY AND VENDOR CHARGES.
Where applicable, Company makes no guarantees on the rates or charge amounts of third-party vendors or amenities service providers that could be relevant to Property. Company will notify Renter of vendor or amenity rate increases as soon as reasonably possible when Company is notified. E.g. In the past we have been given only 30 days notice on an amenity access rate on reservations that paid a lower cost months in advance. There’s nothing we can do about that, sorry.
The Rental Amount includes a fee that is paid as Security Deposit Protection (also referred to as Damage Waiver). In addition, Renter further agrees to pay a Security Deposit (if applicable) within seven (7) days of the Check-in Date indicated above on this Agreement. Renter agrees and understands that the Security Deposit is not to be considered Rent, and that any damages claimed by Company shall not be limited to the amount of the Security Deposit. The security deposit will be held on a major credit card in the amount ranging from $250 to $2000, depending on the property and time of year. This Security Deposit Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The plan will pay a maximum of $1500. Any damages that exceed $1500 will be charged to the credit card on file. The Security Deposit Protection can be purchased up to, and including at, check-in. Please contact Panama City Beach Luxury Properties directly if you do not wish to participate in this plan or assignment.
CHECK-IN AND CHECK-OUT.
Check-in time is 4pm and check-out time is 10am. Early check-in and late check-out may be available depending on occupancy upon request. Non-approved early check-in's and late check-outs will incur a charge of $75 per hour.
CANCELLATIONS AND REFUNDS.
In the event that cancellation is required, revocation must take place within 24 hours of the booking date and time to receive a full refund of the required advanced deposit without penalty. Reservations cancelled after 24 hours will forfeit the initial 45% deposit as a late cancellation fee when the reservation is 31 days out or more. For reservations 30 days out or less you will forfeit the entire amount of your reservation as a late cancellation fee. No exceptions will be made. For additional protection for your vacation, we offer Travel Insurance by CSA.
RULES AND REGULATIONS.
All rental and deposit monies will be forfeited and the Renter will be asked to vacate the Property immediately and or incur extra charges, for a breach of this Agreement, which includes failure to follow the rules below.
1. Absolutely NO SMOKING of any kind in the Property or from the decks or balconies.
2. Pets are NOT allowed in the Property or on the site.
3. Large parties or excessive noise are not allowed.
4. The number of people staying on the Property may not exceed designated amount.
5. Do not have or use fireworks, firecrackers on the Property or on the site.
6. No furnishings or equipment from the Property may be taken out of the property or off site.
7. Do not leave windows and doors open while the air conditioning is on, as this may cause the HVAC units to freeze up and not work properly.
8. All applicable laws as well as association rules and covenants must be observed.
9. Renter may not assign or sublease all or part of this Agreement and Property.
SERVICE AND MAINTENANCE CALLS.
You are staying in a privately owned home or condominium and as such, maintenance issues can arise. While we apologize for any inconvenience of a mechanical failure or utility outage, we will not be able to offer a discount or refund. However if an issue is reported and maintenance determines the issue is the fault of the renter, renter may be held liable for the cost of repair, service, parts and/or labor. While issues are unfortunate, they are a reality when dealing with any form of real estate. We monitor our dedicated maintenance line 24/7, however during periods of high occupancy, there can be delays in getting someone to the property or getting a confirmation return call. We must schedule maintenance calls based on the level of severity of each and every issue. We work tirelessly to ensure everyone is taken care of, however below are some guidelines to help make your stay more enjoyable.
1. Air Conditioner: Do not leave doors and/or windows open while running the a/c as it’s a frequent cause of freezing up the a/c unit. This will cause the a/c unit to not cool and will require a service call. If our team determines the a/c unit froze up because of this you will be reliable for the cost.
2. Refrigerator: Only put items in the refrigerator on the first day that must be refrigerated (e.g. milk, eggs, cheese). Do not load it with bread, sodas, beer, juices and other things you would like to be refrigerated, rather slowly work those other items in over the first 24-48 hours. Surprisingly, this is our most common service call and it’s a refrigerator issue only 7% of the time.
3. TV Remotes: In most properties there will be two remotes for each TV. One is for the TV and the other is for the Cable (it will have XFinity or Mediacom logo on it). The TV must be on channel 3 or 4 (most likely 3) for you to get any channels. Once the TV is on channel 3 or 4, use the XFinity or Mediacom remote to change the cable channels.
4. Hours of Operation: Maintenance is available Monday through Saturday from 9 am to 5 pm central standard time and closed on Sunday. Maintenance is on call for emergencies only until 7 pm daily and our maintenance line is monitored 24/7 to ensure if you have an emergency after 7 pm we can address it if need be. Please note, air conditioning issues must be reported by no later than 7 pm. Because of high demand during heavy occupancy, we cannot guarantee the ability to get a service technician to the property on issues reported after 7 pm. Emergencies include but are not limited to air conditioning issues, floods, leaks, or anything causing damage to the property. Unfortunately while hygiene is important, issues with water heaters (very uncommon), dishwashers, tubs draining, tv’s not working, etc. are not considered emergencies and will be handled with the utmost prudence the following day.
A parking pass will be issued if necessary. Only 1 parking pass per bedroom can be issued with a total maximum number of parking passes issued not to exceed 3. Some individual units may have additional restrictions on parking pass issuance.
Although linens are furnished, please bring your own beach towels, as linens are not to be removed from the Property. An initial supply of paper products, trash liners, bathroom tissue and soap is provided. We keep a strict inventory of every towel, sheet, mattress pad, etc. Do not take them or ruin them with makeup or stains or you will be charged for replacement.
In the event of a hurricane, refunds will be made only in the event of a mandatory evacuation by governmental authorities. Refunds will be granted for the period of the issuance of the mandatory evacuation.
If applicable, each property will have the same number of pool bands as the total number of people it will sleep. If there are any deficiencies at check-in, please report immediately. We keep a strict inventory and this is checked before arrival and after check-out by staff and any missing will incur a $20.00 charge per band missing.
ENTRY BY COMPANY.
Company may enter the Property at any time for any reason. Common reasons for company entrance can include but are not limited to: in case of emergency, to make any necessary repairs, if there have been complaints. Company will attempt to notify renter with at least 24 hours notice of Company’s intent to enter except in case of emergency or complaint.
ADULT ONLY RENTAL.
The Property will not be rented to vacationing students or singles under the age of 25, unless accompanied by and adult guardian or parent who remains on the Property for the duration of the stay. Reservations made under false pretenses will be subject to forfeiture of all monies paid.
Accidental damages up to $1,500 are covered by the one time damage insurance fee (Security Deposit Protection). Any damages that are deemed as NOT accidental or that result in a repair cost in excess of the covered $1,500 will be charged to the credit card we have on file.
Renter shall leave the condo neat and tidy and shall take ALL TRASH out. Cleaning time is approximately 45 minutes for each bedroom of the property (e.g. 3 br takes 3 hrs to clean, 2br takes 2 hrs to clean,etc.), if staff has to go over the allotted time, renter shall be charged $50 per extra hour taken to clean which will be charged to the credit card on file. Time spent shall be rounded up to next full hour.
Other charges above and beyond the Rental Amount can be incurred if damages to the Property occur. If the Property has been found to have been smoked in or other damages found, there will be an additional $250 charge to the Renter. If damage found is estimated to be in excess of $250 to repair, a greater charge could be made.
POOL AND PROPERTY SAFETY.
The pool (if applicable) on the Property is private, there are no lifeguards on duty. For the safety of all, the Renter must keep the pool area secured at all times to prevent unaccompanied children and non-swimmers from access. All pool, deck, steps and other areas of the Property can be slippery when wet. Renter (and Renter ensures that his or her guests) will take responsibility for their own safety, by among other things limiting alcohol intake and watching where they place their feet. The Renter assumes the responsibility that Renter and all guests will strictly observe all pool rules. The Renter understands and assumes the risk that failure to abide by safety rules is a breach of this Agreement and can cause serious injury or death.
After receipt of the Rental Amount, and prior to arrival, the Company will provide the access code or key to the door one week prior to arrival. IMPORTANT: The code and check-in instructions will be provided via email only. Renter is responsible for bringing these instructions with them for their arrival.
AVAILABILITY AND USABILITY.
Company and Renter agree that should Property be destroyed by fire or other casualty so as to become unfit for human habitation, this Agreement shall immediately terminate, and the Owner will then refund to the Tenant the unused Rent for the remaining term of the Lease. Furthermore should the property you are renting be sold, Company reserves the right to cancel this contract anytime. This does not necessarily mean this particular property is for sale.
LIMITATION OF LIABILITY.
To the maximum extent allowed by the law, Company is not liable for Renter’s property left behind or for any consequential, incidental, special, punitive, exemplary or indirect damages from any cause whatsoever, regardless of whether they were foreseeable. Company’s maximum aggregate liability arising out of the rental of the Property to Renter is limited to the rental amount paid by Renter during the Rental Period. The Company is not undertaking to provide any security and is not responsible for any loss or theft of the Renter’s property.
To the maximum extent allowed by the law, the Renter agrees to indemnify, hold harmless, and at the Company’s option, defend the Company and its officers, members, contractors and representatives from all liabilities, claims, actions, damages, costs, and expenses that Renter or Renter’s guests may have or bring against any one or more of the Indemnified Parties or that arise from the Renter’s rental of the Property under this Agreement, including any claims based on negligence, action, or inaction of any of the Indemnified Parties.
In the event that either party brings any action or proceeding to enforce any term, covenant or condition of this agreement, then the prevailing party in such litigation shall be entitled to recover from the other party reasonable attorney’s fees to be fixed by the court in such action or proceeding. Furthermore, Renter agrees to pay the attorney’s fees and expenses of Company if Company is made a part to litigation because of its being a party to this Lease and when it has not engaged in any wrongful conduct itself, if brought about by wrongful conduct of tenant.
This Agreement will be governed by the laws of Florida, without regard to conflicts of law principles.
This Agreement contains the entire agreement between the parties and there are no other promises, terms or conditions, whether oral or written, other than contained herein. These Terms and Conditions may be modified only in writing signed by both parties. Checking the Terms and Conditions box required to book online confirms the Renter acknowledges that he/she has read and agrees to abide by these Terms and Conditions, however receipt of payment implies agreement of all terms and conditions. Company may change Terms & conditions without notice at any time.
